Sean “Diddy” Combs has filed a new appeal, seeking to have his conviction overturned and his prison sentence reconsidered. As Radar Online reported, in a new move, the musician's defense criticized Judge Arun Subramanian, calling his sentence “draconian”.
Combs' attorneys are pushing for the 50-month sentence to be overturned and the rapper released or at least given a significantly reduced sentence. In the documents, the defense contends that the judge “overstepped the mark” and actually acted not as an arbitrator but as an additional juror, such that he was named “the 13th juror” in the complaint.
Lead appeals attorney Alexandra Shapiro said the judge relied on the charges on which Combs was acquitted in sentencing. We are talking about cases of sex trafficking and fraud – on these charges, the jury found the musician not guilty. At the same time, according to the defense, the judge allowed for the possibility of reviewing Combs' conduct regarding these more serious charges, which allegedly violated his constitutional rights.
Combs was only convicted of two counts of transporting a person for the purpose of prostitution. The lawyers emphasized that the verdict should be based solely on these points. In previous appeals, the defense also argued that Combs did not violate the law for allegedly failing to arrange trips or pay for the prostitutes' services.
