According to Khaminsky, subway staff may not allow passengers to travel if they refuse to show their phones. At the same time, the lawyer emphasized that such a check is carried out in order to identify a potential explosive device disguised as a device – for this, the passenger only needs to turn on the phone, without unlocking it. Checking the contents of the phone requires the voluntary consent of the citizen or a court decision.
“This is done to exclude the possibility of using the body of the device to transport explosives. Checking the contents of the phone, including correspondence, photos, applications, by law requires the voluntary consent of the citizen or a court decision. This provision is guaranteed by Article 23 of the Constitution of the Russian Federation on confidentiality of correspondence and the inviolability of private life”, he explained.
Previously, it became known that the Moscow metro began selectively checking passengers' phones.
