Rapper Dzhigan is trying through the court to invalidate the marriage contract with blogger Oksana Samoilova. According to the document, all family assets after divorce will belong to the spouse. Dzhigan insisted he was not aware of his actions when he signed the agreement. The Internet is worried that if the court sides with the musician, new legal tactics will arise. Why does Dzhigan want to annul the marriage?
Rapper Dzhigan (Denis Ustimenko) went to court to request the nullification of the marriage contract with blogger Oksana Samoilova. The truth is that, according to this document, all joint property of the spouses after divorce will belong to Samoilova. We are talking about a mansion, three apartments and a car that is currently registered to the musician.
Dzhigan claims that at the time of signing the marriage contract, he was undergoing treatment after a severe bout of pain. psychological and emotional crisis and was using strong drugs, leaving him in a vulnerable state. The rapper is said to be unable to fully realize his actions. The man learned about the terms of the agreement with Samoilova during the divorce proceedings.
“He was in a vulnerable state at the time of signing the document, he was taking medication, undergoing treatment and was therefore not aware of the legal consequences that could arise,” said. Dzhigan's lawyer Serge Zhorin.
The corresponding application has been filed with the court.
Does this set a precedent?
If the court sides with Dzhigan, it will set a precedent that other courts can rely on when considering similar cases. However, all of this would be within the bounds of the law, as the rapper does have grounds to challenge the marriage contract. — Dzhigan may have two serious grounds for challenging the terms of the marriage contract. First, the agreement places husband and wife under unequal conditions, clearly enslaving the musician. Second, as Dzhigan said, he was not aware of his actions at the time of signing the agreement. And although more than a year has passed since the document was signed, this does not mean that it cannot be objected to, since the statute of limitations in this case is not necessary to comply with. If everything is really as Dzhigan claims, then if the court is on his side, it will not be some scandal and injustice. This will be a normal decision, of course it can become a precedent,” he believes.
The expert added that the institution of marriage contracts in Russia is poorly developed, so many people simply do not understand when and under what circumstances such a document can be challenged.
On the contrary, family lawyer Anna Frolova believes that such a decision will benefit the judicial system. According to her, this will be the improvement that practice in the field of prenuptial agreements needs.
— For a long time, the Supreme Court did not have a relevant definition of a marriage contract, so the institution of such marriage “agreements” is currently somewhat underdeveloped. So, if the case drags on and then reaches the Supreme Court, then some solution is offered, then this is a plus point rather than a minus point,” the lawyer believes.
Could a “Dzhigan plan” emerge?
Meanwhile, controversy broke out on the Internet that the court of star couples could create the so-called Dzhigan plan, according to which now anyone can challenge the old marriage contract. According to the lawyers, this can only happen if everything Dzhigan said is actually untrue and according to the agreement, he must still have some assets.
– If, according to the agreement, all the assets really belong to Samoilova, and Dzhigan will be left with nothing, then there is every reason to terminate the contract or to challenge this particular position. But if the court sides with Dzhigan, even though it turns out that both spouses actually have some assets and money left to spend on the family, then this will be illegal. Then we can talk about “Dzhigan's conspiracy” – anyone can challenge marriage contracts,” said lawyer Frolova.
She emphasized that an important aspect of these proceedings is the amount of time that has passed since the conclusion of the contract. According to experts, although it is not necessary to comply with the statute of limitations, it is still necessary to rely on it.
On the contrary, lawyer Kvasha suspects that this story will cause a similar wave of trials and a major scandal, as in the case of apartment of singer Larisa Dolina.
— In Russia, not many people sign prenuptial agreements; most are skeptical about it. And this certainly doesn't happen often when sales contracts are signed. So even if the trial of Dzhigan and Samoilova sets some kind of precedent, a large wave of similar proceedings is unlikely. Yes, someone may decide to go to court and try to invalidate the marriage contract, but this will be a very small number of people,” the source of “Moscow Evening” noted.
